1. Acceptance of Terms
By accessing, browsing, creating an account, submitting documents, placing items into an RFQ list, or submitting any request for quotation (“RFQ”) on this website (the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Platform.
2. RFQ-Only Catalog
The Platform is an RFQ-based catalog. Product information is provided for reference purposes only and may be updated, corrected, or changed without notice. Any RFQ submission is not a purchase order and does not create any binding obligation on Pharmastar Int’l Trading Corp / Pharmastar Diagnostics (“Pharmastar”) to sell, deliver, reserve, or provide pricing. Pricing, availability, lead times, and specifications are confirmed only through official quotation and/or written confirmation.
3. Account Eligibility & Business Use
Accounts are intended for legitimate businesses, hospitals, laboratories, clinics, and authorized procurement representatives. You represent that you have the authority to act on behalf of the organization you identify during signup and RFQ submissions.
4. Required Documents & Verification
To ensure compliance and responsible transactions, the Platform may require submission of business verification documents, including but not limited to: Company Profile, Mayor’s Permit, SEC Registration, and BIR Registration/TIN documentation (“Verification Documents”). Pharmastar may verify documents, request clarifications, refuse access, suspend accounts, or decline RFQs at its sole discretion.
5. Truthfulness of Information & Fraud
You agree that all information you provide (including name, email, contact details, company information, and Verification Documents) is true, accurate, current, and complete. You must not submit forged, falsified, misleading, stolen, altered, or otherwise fraudulent information or documents.
IMPORTANT: If you submit a fake name, impersonate another person or organization, or provide fake/forged/misleading company documents, Pharmastar reserves the right to (a) suspend or terminate your account immediately, (b) cancel or refuse RFQs and quotations, (c) preserve and disclose information to authorities as required by law, and (d) pursue all remedies available under applicable Philippine laws, including filing civil and/or criminal complaints where appropriate.
6. Acceptable Use
- You must not use the Platform for unlawful, abusive, or deceptive purposes.
- You must not attempt to bypass security, scrape data, or interfere with Platform operations.
- You must not submit RFQs in bad faith or for the purpose of manipulating availability, pricing, or operations.
7. Intellectual Property
The Platform content (including logos, designs, text, images, and product information layout) is owned by Pharmastar or its licensors and is protected by applicable laws. You may not copy, distribute, publish, reverse engineer, or exploit the Platform content without written permission.
8. Confidentiality of Quotations
Any quotation, proposal, or pricing information provided by Pharmastar may be treated as confidential business information. You agree not to disclose or publish such information without Pharmastar’s written consent, unless required by law.
9. Disclaimers
The Platform is provided on an “as is” and “as available” basis. Pharmastar makes no warranties that the Platform will be uninterrupted, error-free, or free of harmful components. Pharmastar disclaims all warranties to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Pharmastar shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising from your use of the Platform.
11. Data Privacy
You acknowledge that information and documents you submit may be used for verification, account management, quotation processing, compliance, and customer support. Pharmastar will handle personal data in accordance with applicable laws and internal policies.
12. Suspension / Termination
Pharmastar may suspend or terminate accounts that violate these Terms, appear fraudulent, or present operational, security, or compliance risks. Pharmastar may also refuse RFQs at its discretion.
13. Changes to Terms
Pharmastar may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be brought before the proper courts with jurisdiction.
